Forced Disappearances: Positive Step Taken
The working group tasked with preparing a legally binding international instrument on forced disappearances ended its work on a positive note this week. The negotiations, presided by France, led to the adoption of a draft convention which will be presented in March 2006 to the members of the UN General Assembly Human Rights Committee for approval. A signing ceremony will then be held in Paris.
The new instrument details specific measures to be integrated into every state’s national legislation in order to prevent and punish political kidnappings carried out or ordered by the government or groups acting for it. It solemnly confirms that the widespread practice of “disappearances” is a crime against humanity. It establishes a follow-up organ, with a secretariat provided by the Office of the High Commissioner for Human Rights, which is capable of reacting urgently to any threat of forced disappearance. Anyone with an interest in doing so may refer a case to this independent committee at any time.
After 25 years of mobilization a decisive step has therefore been taken in the combat against forced disappearances, a particularly heinous crime since it violates all human rights.
